1. Sellers

The vehicles on this website are sold, as the case may be, by one of these two self-employed professionals operating under the trade name «Plata Garage»:

2. Purpose

These terms govern the reservation and, where applicable, the sale of the used vehicles we offer on this website.

3. Seller of each vehicle

Each vehicle is sold by one of the two sellers named. The specific seller appears on the reservation document, the sale contract and the invoice. The deposit, invoice and warranty all correspond to that same seller.

4. Reservation and deposit

4.1. En los vehículos que lo indican puedes reservar con una señal, en persona o desde la web. La señal se paga por Bizum, por transferencia bancaria a la cuenta del vendedor o, cuando el vehículo lo permite, con tarjeta, Apple Pay o Google Pay a través de Stripe, la plataforma de pago segura que usamos. Los datos de tu tarjeta los trata Stripe; nosotros no los vemos ni los guardamos.

4.1 bis. Cuando comprobamos que hemos recibido la señal, te confirmamos la reserva y te enviamos por email el documento de reserva. El vehículo también se enseña en nuestras instalaciones y puede haberse vendido justo antes de recibir tu señal: si es así, te lo comunicamos y te devolvemos la señal íntegra.

4.2. Once the deposit is received, the vehicle is reserved for you for seven (7) calendar days and taken off sale.

4.3. If you complete the purchase, the deposit is deducted from the total price.

4.4. Si decides no comprar, la señal no se devuelve, sin perjuicio del derecho de desistimiento que te corresponda como consumidor según el punto 7. La señal se devuelve íntegra si el vendedor no puede llevar a cabo la venta, si el vehículo no se corresponde con lo ofertado o si la compra se hace con financiación y la entidad financiera no la aprueba.

5. Price and payment

5.1. Prices are in euros. If the sale involves any additional cost, you'll be told before it is completed.

5.2. Used vehicles may be sold under the Special Scheme for Second-hand Goods (REBU); in that case VAT is not shown separately on the invoice.

5.3. The rest of the price is paid on handover, by bank transfer, finance or another method agreed with the seller.

6. Warranty

Vehicles sold to consumers carry the warranty established by Royal Legislative Decree 1/2007 (TRLGDCU). We offer a twelve (12)-month warranty, on the terms set out in the sale contract and in the warranty document handed over with the vehicle. It is provided by the vehicle's seller.

7. Right of withdrawal

7.1. If the reservation is made at a distance, as a consumer you have fourteen (14) calendar days to withdraw from it without giving reasons, under the TRLGDCU and subject to the exceptions provided by law.

7.2. Para ejercerlo basta con comunicarlo de forma clara a info@platagarage.com antes de que acabe el plazo. Puedes usar el modelo de formulario que tienes al final de esta página, aunque no es obligatorio.

7.2 bis. Si desistes, te devolvemos la señal sin demora y, como máximo, en catorce (14) días naturales desde que nos lo comuniques, por el mismo medio de pago que usaste, salvo que acordemos otro, y sin ningún gasto para ti.

7.3. The vehicle sale is signed and the vehicle handed over in person.

7.4. Reservations made in person at our premises are not distance contracts and do not carry this right of withdrawal; they are governed by the signed reservation document.

8. Data protection

We process reservation and purchase data in accordance with our privacy policy.

9. Applicable law

These terms are governed by Spanish law. Any dispute shall be subject to the courts of Sabadell (Barcelona), except where the law grants the consumer a different jurisdiction.
